WEBSITE TERMS OF USE

DaarZood, a company registered in 2018, with a registered address at Al Ain, UAE, owns and operates the e-commerce website http://www.daarzood.com.

TERMS AND CONDITIONS:
These Terms and Conditions (the "Terms") are an agreement between DaarZood and you, as a user of the Website. By accessing the Website, registering an Account, ordering any Product, or otherwise availing the services offered by DaarZood via the Website, you agree to be bound by the Terms. If you do not agree with any provision in the Terms, your sole recourse is to discontinue your use of the Website.
1. These Terms and Conditions (the "Terms") are an agreement between DaarZood and you, as a user of the Website. By accessing the Website, registering an Account, ordering any Product, or otherwise availing the services offered by DaarZood via the Website, you agree to be bound by the Terms. If you do not agree with any provision in the Terms, your sole recourse is to discontinue your use of the Website.
2. The Website is intended to allow you and other users to browse and order products and other goods or services ("Products") offered for sale on the Website. DaarZood will use reasonable efforts to include up-to-date and accurate information in the Website, but it reserves the right to delete, modify, or supplement the content of the Website at any time for any reason without prior notification.
3. Changes in law or changes in DaarZood’s business may require changes to be made to the Terms from time to time. Such changes will become effective from the date on which they are made available on the Website. DaarZood encourages you to review the Terms periodically for any such changes.
ACCOUNT REGISTRATION
1. You may browse some parts of the Website without registering, but in order to access certain functions of the Website, including the ability to order and purchase Products, you must register and create an account secured by a password (the "Account"). Any Account so created is personal to you, and you may not transfer it to another person.
2. If you register and create an Account, you are a "Registered User". To become a Registered User, you must be the legal age of majority in your home country, and you must provide true, accurate, complete and current information (including name, email address, credit card details, and other details) as requested during the Account creation process. You warrant that all information provided by you is true, accurate, complete and current, and you undertake to keep such information up-to-date. The personal information you provide to DaarZood in the course of using the Website will be used in accordance with our Privacy Policy, the terms of which are hereby incorporated into the Terms. If you are under the legal age of majority in your home country, you may not open an Account. (Consider asking a parent or guardian to order Products for you via their own Account.)
3. You are responsible for maintaining the confidentiality of your Account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your Account or password.
PRODUCTS, ORDERING AND PAYMENT
1. As a Registered User, you may use the Website to order and purchase Products. You agree to pay the full amount payable for such Products as indicated during the order process, along with any taxes, shipping costs or other charges applicable to that order. The currency in which prices are displayed may vary, so please pay particular attention to the currency you select. All prices are subject to change without notice.
2. Upon acceptance of your order you will receive an order confirmation including details such as the price of the Product, the estimated date of delivery, and the order number. If you wish to make changes to your order you can contact us on onlineorders@daarzood.com or +971 2 445 8500.
3. DaarZood may not accept your order for a Product in a variety of situations, including: if the item is out of stock, if DaarZood is unable to obtain authorisation for your payment, if shipping restrictions apply to a particular Product, or for any other reason (at DaarZood’s sole discretion). DaarZood will not process your payment (or will cease processing your order) in these types of situations, and will not be liable to you or any third party by reason of its decision to decline processing, or unwinding or suspending any transaction after processing has begun. DaarZood reserves the right to refuse service, terminate your Account, or cancel orders, at its sole discretion.
4. If the Product is no longer available, DaarZood may, at its sole discretion, offer you the opportunity to purchase a Product of equivalent value. This condition will not apply if the Product is temporarily out of stock.
5. From time to time, there may be errors in the pricing that appears on the Website or during the order process. There may also be errors in transmission resulting in the interruption of your purchase. DaarZood will in good faith try to resolve any issues that may arise as a result of such errors. You agree to cooperate with DaarZood to resolve such issues, and you agree that DaarZood shall have full discretion to determine the appropriate resolution in such cases, noting that DaarZood will verify pricing when processing your order and before we take payment. If DaarZood has made a mistake and a Product's correct price is higher than the price on the Website, DaarZood may either contact you before dispatch to request whether you want to buy the product at the correct price or cancel your order. If a Product's correct price is lower than the stated price, DaarZood will charge the lower amount and dispatch the Product to you after confirmation of payment.
6. If the issuer of your credit or debit card refuses to authorise payment, DaarZood will cancel your order and contact you for an alternative method of payment. DaarZood cannot be held responsible if this should result in a delay in dispatching your Products.
SHIPPING
1. DaarZood – Will ship the items via its own delivery system within same day of delivery date (varies according to locations and services). Delivery is currently provided to cities within UAE and limited to Abu Dhabi and Dubai Emirates. Delivery charge is applicable for any failed attempts of order delivery. Packaging and cost of dispatch will be borne by DaarZood. DaarZood will cover all losses in case of loss or damage,
2. Risk of loss and title for the Products that you purchase on the Website pass to you upon DaarZood’s delivery of your ordered and purchased Products to the shipping carrier.
3. DaarZood may only ship to certain countries (including the UAE). If your country is not one of the countries DaarZood ships to, you can contact us to enquire about alternative means of delivery.
4. DaarZood will provide you with an estimate delivery time upon acceptance of your order. You should use the estimated delivery times as a guide only. DaarZood is not responsible for any delays or loss in the shipping of your Product. A delivery must be accepted and signed for by a person over the legal age of majority in your home country. If DaarZood is unable to complete delivery because there is nobody at home, it will be your responsibility to contact DaarZood to arrange a new delivery time. If DaarZood in unable to complete delivery on the first attempt for reasons outside the control of DaarZood, DaarZood reserves the right to charge you additional fees and any such fees shall be subject to agreement between you and DaarZood.
5. You are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the Products. While DaarZood will ensure that your personal information is at all times used in accordance with our Privacy Policy, you must note that cross-border deliveries are subject to opening and inspection by customs authorities for which DaarZood bears no responsibility. DaarZood shall not be responsible for any instance in which Products ordered via the Website are delayed, detained or destroyed by local customs authorities due to non-compliance with local requirements. International deliveries may be subject to import duties and taxes, which are levied once the package reaches the specified destination. You are responsible for any additional charges for customs clearance; DaarZood has no control over these charges. Customs policies vary widely from country to country, and so DaarZood encourages you to contact your local customs office for further information.
REFUNDS AND EXCHANGES
1. Products ordered, purchased and delivered through the Website are not eligible for return or exchange. Cancellation of orders will not be accepted with in one day prior to the requested delivery date.
2. REFUNDS ON CANCELLED ORDERS.
  1. Online Payment
    Refunds will be processed within 48 hours and will be credited to the customer account within 5-7 working days depending on the issuing bank.
  2. Cash on Delivery
    Refunds will be credited to the customer's account as store credit and can be used for the subsequent order in the future.
DISCLAIMER OF WARRANTY; LIMITATION OF LIABILITY; INDEMNITY
1. The Website and its content are provided on an "as is" and "as available" basis and, to the extent lawful, with no warranties whatsoever. DaarZood, its parents, subsidiaries, affiliates, and their respective suppliers, and any of their owners, officers, directors, managers, members, agents, and employees, expressly disclaim (to the fullest extent permitted by applicable law) any and all express, implied, and statutory warranties, including, without limitation, any warranties of merchantability, fitness for a particular purpose, freedom from computer virus, title, and non-infringement of proprietary rights.

To the maximum extent permissible by applicable law, DaarZood, its parents, subsidiaries, affiliates, and their respective suppliers, and any of their owners, officers, directors, managers, members, agents, and employees, are not liable for any direct, indirect, punitive, incidental, special, or consequential damages or loss (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption) arising out of, or in way connected with, the use or inability to use the Website and its content, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not DaarZood is advised of the possibility of such damages.
3. DaarZood, its parents, subsidiaries, affiliates, and their respective suppliers, and any of their owners, officers, directors, managers, members, agents, and employees, are not responsible for, and to the maximum extent permissible by applicable law, exclude any and all liability for damages caused by, any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any communications due to technical problems or traffic congestion on the Internet or on the Website or combination thereof, including any injury or damage to any users or to any person's computer related to or resulting from use of the Website.
4. You agree to hold harmless and indemnify DaarZood, its parents, subsidiaries, affiliates, and their respective suppliers, and any of their owners, officers, directors, managers, members, agents, and employees, from and against any claims, liabilities, suits, judgments, litigation costs, causes of action, demands, recoveries, losses, damages (actual and consequential), fines, penalties, and attorneys’ fees or other costs or expenses of any kind or nature arising from or in any way related to your use of the Website, including, but not limited to those brought by you or on your behalf in excess of the liability described above, or by third parties as a result of your breach of these Terms, your violation of any law or the rights of a third party, or your use of this Website.
GENERAL
1. Change of Website and cessation of operations: DaarZood reserves the right to change or correct any errors or omissions in the Website, and to alter, limit or discontinue the provision of any of the services provided via the Website, at any time without prior notice to you.
2. Third party links and advertisements: DaarZood does not recommend or endorse the content or privacy practices of any third party sites which may be linked to or from the Website, or products or services of any third parties mentioned or described on the Website or linked to or from the Website. You acknowledge that that DaarZood is not responsible for third party sites and that you enter any third party sites at your own risk. This Website may contain advertisements for third parties’ goods and/or services. The third party advertisers are responsible for the accuracy of all representations made in those advertisements. DaarZood does not recommend or endorse any third party goods or services that may be advertised on the Website. If you choose to order a product or service advertised by a third party on the Website, you do so at your own risk.
3. Intellectual property: The Website content is protected by copyright, trade mark and other intellectual property rights. DaarZood, or its licensors, retain all rights in such content. Termination: DaarZood may terminate or suspend your access to all or part of this Website, without prior notice, if it believes that your conduct is in violation of these Terms, applicable law, or otherwise harmful to the interests of DaarZood or any third party. Notwithstanding such termination or suspension, you will continue to be subject to clauses 6, 7.3, 7.4, 7.5 and 7.6 of these Terms.
6. Governing law and jurisdiction: The Terms shall be governed by the laws of Abu Dhabi, United Arab Emirates. Any dispute regarding these Terms and Conditions shall be subject to the exclusive jurisdiction of the Courts in Abu Dhabi. If any portion of the Terms is held to be unenforceable, invalid or illegal by any court of competent jurisdiction, the remainder of the Terms shall not be affected.
